CMS Update to COVID-19 Emergency Declaration Blanket Waivers Related to SNFs



On April 7th, CMS released a memorandum (QSO-22-15-NH & NLTC & LSC) ending specific COVID-19 waivers in two groups, one within 30 days and one within 60 days of April 7th.


“CMS continues to review the need for existing emergency blanket waivers issued in response to the Coronavirus Disease 2019 (COVID-19) Public Health Emergency (PHE).”


SNF related waivers ending are noted below – Returning to pre-Covid requirements (detail included in attached CMS Memorandum)

30 days - May 7th

• Resident Groups

• Physician Delegation of Tasks

• Physician Visits

• QAPI

• Detailed Information Sharing for Discharge Planning

• Clinical Records


60 days – June 6th

• Physical Environment for SNF/NFs

• Life Safety Codes and Health Care facilities Code ITM for Inpatient Hospice

• Outside Windows and Doors for Inpatient Hospice

• Paid Feeding Assistants

• In-Service Training

• Training & Certification for Nurse Aides


Let's Get to the Point:

The Public Health Emergency (PHE) is still in effect through April 15th - including the 3-day hospitalization waiver, and other waivers not noted above. There is still speculation that the PHE will be extended for another 90 days. Please refer to the attached CMS Memorandum for details on the above retired waivers.
